Terms of Service ZenXNet

1. General Provisions

1.1. This Terms of Service Agreement (hereinafter "Agreement") is a public offer by ZENXNET GLOBAL LTD (hereinafter "Service," "we") and sets forth the terms of using the ZenXNet VPN service (hereinafter "Service"), provided through the official Telegram bot (hereinafter "Bot") and/or the website at zenxnet.com (hereinafter "Site").

1.2. The acceptance of this offer occurs when the User takes actions aimed at obtaining the Service, in particular, paying for a subscription. Beginning to use the Service also means agreeing to the terms of this Agreement.

1.3. This Agreement comes into force from the moment of its acceptance by the User and is valid for the entire period of using the Service.

1.4. The Service is intended for persons aged 18 and over. By accepting this Agreement, the User confirms that they are at least 18 years old or use the Service with the consent of a legal representative.

2. Subject of the Agreement

2.1. The Service undertakes to provide the User with access to the VPN service under the conditions stipulated by this Agreement and the subscription plan selected by the User.

2.2. The Service includes providing secure and private Internet access via a VPN connection through servers selected by the User.

2.3. The Service is provided "as is," and we do not guarantee uninterrupted operation, complete anonymity, or availability of all internet resources.

3. Rights and Obligations of the Parties

3.1. Obligations of the Service:

  • Provide the User with access to the VPN service according to the selected subscription plan.
  • Provide technical support regarding the use of the Service.
  • Take measures to protect the User's personal data in accordance with the Privacy Policy.

3.2. Obligations of the User:

  • Pay for the subscription according to the selected plan and payment terms.
  • Comply with the Terms of Use and the provisions of this Agreement.
  • Do not use the Service for illegal purposes (distribution of illegal content, phishing, hacking, spam).
  • Do not use P2P networks for downloading and distributing files (forbidden by the terms of service).
  • Do not transfer account credentials to third parties.

3.3. Prohibited Use (Acceptable Use Policy):

The following activities are strictly prohibited when using the Service:

  • Sending spam, bulk unsolicited email, or operating open mail relays;
  • Phishing, fraud, extortion, and identity theft;
  • Distributing malware, operating botnets or command-and-control infrastructure;
  • Unauthorized access attempts, brute-force attacks, port or vulnerability scanning of third-party systems;
  • DoS/DDoS attacks or any deliberate disruption of networks and services;
  • Any form of child sexual abuse material (CSAM) — zero tolerance, immediate permanent block;
  • Trade in illegal goods and services;
  • Copyright infringement, including file sharing via P2P networks (clause 3.2);
  • Reselling access to the Service without the Service's written consent.

Violation of this clause results in immediate blocking of the key without a refund (clause 7.4). To report a violation, contact abuse@zenxnet.com.

3.4. Subscription Plans:
• STANDARD: Basic protection, up to 3 devices per subscription.
• PREMIUM: Increased limit up to 10 devices per subscription.
3.5. Plan Upgrade:
A STANDARD plan user can upgrade to the PREMIUM plan at any time. In this case:
• The upgrade cost is calculated proportionally to the remaining subscription days.
• The subscription duration is preserved; the limits are updated instantly.
• Downgrading from PREMIUM to STANDARD is not supported.
3.6. Device Limits:
Violating the established limits (3 for Standard, 10 for Premium) may result in temporary automatic access block until the violation is resolved.

Devices connected to the Internet through a router or any other equipment that relays access are counted towards the plan limit on the same basis as directly connected devices, regardless of whether they appear in the personal account.

Router configuration is provided by the Service on the PREMIUM plan by means of the WireGuard configuration supplied by the Service. Other methods of connecting a router are neither provided nor supported by the Service: the operability of such connections is not guaranteed, and a configuration change on the Service side is not a ground for a refund (cl. 7.4).

4. Cost and Payment Procedure

4.1. The subscription cost is determined by the current prices published in the Bot and on the Site.

4.2. Payment is made through bank cards, electronic wallets, cryptocurrency, and other payment methods available on the Site or in the Bot.

4.3. Upon expiration of the subscription period, access is suspended. Renewals are added to the current period.

4.4. Keys are not auto-renewed: renewal happens only at the User's initiative. The Service does not store card details and makes no automatic charges.

5. Liability of the Parties

5.1. The Service is not liable for interruptions caused by the actions of Internet Service Providers (ISPs), network blocks imposed by government or regulatory authorities in any jurisdiction, or the blocking of specific network protocols at the ISP level.

5.2. The User bears full responsibility for the legality of their actions when using the VPN.

6. Primary and Additional (Bonus) Subscriptions

6.1. The subject of this Agreement is the User's purchase of the primary VPN subscription.

6.2. As an addition to the primary subscription, the Service may grant access to bonus connections (alternative protocols, experimental gateways, etc.). The composition, parameters, and availability of bonus connections are determined by the Service and can be changed unilaterally at any time.

6.3. Initial access to bonus connections is provided free of charge. The User has the right, at their own discretion, to purchase additional technical parameters for bonus connections (e.g., traffic volume, expanded limits).

6.4. The purchase of additional parameters (clause 6.3) is voluntary and does not change the connection's status as a bonus/additional relative to the primary subscription.

Legal Clarification: The inoperability of additional connection types or dissatisfaction with their limits is not grounds for a refund for the primary subscription, as it does not violate the subject of the Agreement (clause 6.1).

7. Refund Policy

7.1. A refund for the primary subscription is possible within 7 (seven) calendar days from the date of payment in either of the following cases: (a) confirmed technical inoperability of the main service caused by the fault of the Service (server configuration errors, unreachability of the control panel); or (b) the User's dissatisfaction with the service. A refund on ground (b) is provided where payment was made by a refundable method (bank cards, SBP, e-wallets); refunds for payments made via cryptocurrency are governed by clause 7.5.

7.2. Blocking of access to the service or its specific protocols by government or regulatory authorities (clause 5.1) is a force majeure circumstance and is not a ground for a refund.

7.3. Funds for purchased additional parameters (traffic and other limits for bonus connections) are non-refundable.

7.4. Refunds are not provided in cases of: account ban due to Agreement violation, issues on the User's ISP side, or if the service is used on technically unsupported devices.

7.5. Payments made via cryptocurrency are final and non-refundable due to the irreversible nature of blockchain transactions.

7.6. Payment for a plan change (upgrade from STANDARD to PREMIUM) is non-refundable, as the upgrade service is deemed rendered at the moment the key's enhanced parameters are activated.

7.7. A refund on ground (b) of clause 7.1 (dissatisfaction with the service) is available no more than once per User within any 6 (six) month period. Repeated refund requests on this ground within that period are not satisfied.

8. Term and Termination

8.1. This Agreement remains in force for the entire validity period of the purchased access key and terminates upon its expiry unless renewed.

8.2. The Service is entitled to suspend or terminate access without a refund in the event of a violation of this Agreement, including the Acceptable Use Policy (clause 3.3).

8.3. The User may stop using the Service and request account deletion at any time via account settings or by contacting support. Deletion of the account does not entitle the User to a refund for the unused period, except in the cases set out in Section 7.

9. Changes to Terms and Governing Law

9.1. The Service reserves the right to amend this Agreement unilaterally. The current version is always published on the Site with an updated "Last updated" date. Where changes are material, the Service will additionally endeavour to notify Users by email or Telegram.

9.2. Continued use of the Service after a new version takes effect constitutes acceptance of the amended terms. If the User disagrees with the changes, they must stop using the Service.

9.3. This Agreement is governed by the law of England and Wales. The parties shall first seek to resolve any dispute through negotiation via the support contacts; failing that, disputes are subject to the jurisdiction of the courts of England and Wales.

9.4. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full force and effect.

9.5. This Agreement is made in English and Russian. In the event of any discrepancy between the versions, the English version shall prevail.

10. Registration, Territory, and Fair Use

10.1. An account is created upon first sign-in via email or Telegram on the Site or in the Bot; the identifier used at sign-in becomes the account identifier. No separate registration procedure is required.

10.2. The User is responsible for keeping access to their email, Telegram account, and access keys secure. All actions performed from the User's account are deemed to be actions of the User.

10.3. The Service is provided worldwide. The availability of specific servers, locations, and protocols may vary by region and change over time. The User is solely responsible for ensuring that the use of VPN technology is lawful in their jurisdiction.

10.4. Unlimited traffic is provided for normal personal use. In the event of anomalous load that degrades service quality for other users (for example, use of the key as a public gateway or continuous automated traffic), the Service may limit the connection speed, notifying the User where possible.

11. Intellectual Property and Liability Limits

11.1. The Site, browser extension, configurations, trademarks, and other intellectual property of the Service belong to the Service. The User is granted a limited, non-exclusive, non-transferable licence to use the Service for personal purposes during the paid period.

11.2. The User shall indemnify and hold the Service harmless from third-party claims arising out of the User's violation of this Agreement or unlawful use of the Service.

11.3. The aggregate liability of the Service under this Agreement is limited to the amount paid by the User for the current paid period of the key. Indirect losses and lost profits are not compensated.

12. Referral Program

12.1. The Service may offer a referral (affiliate) program. Its current terms, reward amounts, and withdrawal rules are published in the user dashboard on the Site and in the Bot, and may be changed by the Service unilaterally.

12.2. Rewards accrued for referred users' payments may be cancelled if the payment is refunded or charged back, or if abuse is detected (self-referrals, fictitious payments, mass registrations). In the event of abuse the Service may cancel accrued rewards and suspend the User's participation in the program.
